In 2010, the Coalition sued the State of New York to compel the state to reimburse foster parents for “the cost of (and cost of providing) food, clothing, shelter, daily supervision, school supplies, a child’s personal incidentals” and other expenses as mandated in the federal Adoption Assistance and Child Welfare Act.
It has taken over nine years just to have the courts agree that the Coalition has a right to bring the state to court on behalf of families in order to challenge the inadequate foster care payments. Recently, the United States Court of Appeals for the Second Circuit issued their decision that the Coalition does have this right. This is an important step forward.
Now, New York State has a decision to make: Will the state fight the foster families who provide homes and care for the children in the state’s custody? Will the state accept that foster families are entitled to reimbursement for providing basic necessities such as food, clothing and shelter for the children in the state’s care?
Or, will the state fight in court or do right by kids?
No matter what, the Coalition will continue to fight for what children in foster care need. But litigation is — and has been — a long, hard fight. The Governor can end this now.
We want the state to be responsible. We want the State to step up and change its foster care reimbursement rates and policies.
And you can help us do that by putting pressure on the Governor.

You can use the draft copy below for your messaging or make it more personal. The overall message is that we would like the state to end this lawsuit now and stop fighting foster families in court. Offer an agreement that is fair to foster families. We are asking them to be responsible and follow the federal law. Our advice is always to be concise and respectful.
Governor Andrew Cuomo has a reputation for fighting for social, racial and economic justice for all New Yorkers.
Under his leadership, New York passed marriage equality, a $15 minimum wage, the strongest paid family leave program in the nation, the strongest gun safety laws in the nation, equal rights for women, greater protections for immigrants, the largest investment in education in state history, cut taxes for the middle class, implemented a 2% property tax cap, put more New Yorkers to work than ever before, and became the first state in the nation to offer free college tuition for middle-class families.
So why won’t New York support foster families? Don’t make the courts find New York State negligent for the children in care. Play fair with foster care and don’t fight foster families!
