Foster Parent Liability Insurance

Foster parents, who receive no salary for their services, are and can be vulnerable to lawsuits.

Historically, the Coalition has supported and advocated for the implementation of a liability and property damage insurance package for foster parents. Such a package would protect foster parents from liability for acts of the child in care and from lawsuits brought by the biological parent, the child, or others arising out of the foster parent/child relationship. Many studies identify liability insurance – subsidized or provided at no cost to foster parents – as a key to retaining qualified foster parents. The Coalition has previously conducted a statewide survey to collect data and included the issue of Foster Parent Liability Insurance in the Foster Care Reimbursement Lawsuit.

We have been exploring available options for liability insurance for NYS foster parents. We’ve found there are, currently, no comprehensive liability policies available for purchase in New York State.

We’d like to change that.

In our capacity as the state’s foster and adoptive parent association; the Coalition has been consulting with Robert A. Brotemarkle of  Foster Parent Professionals to develop of a package of liability coverages for NYS foster parents. Together, we are spearheading a potential opportunity for the Coalition to create the pool for a group plan for foster parents in New York State.

Robert will go over all the important facts and have answers to any questions you might have.

We are looking to provide liability insurance to provide enrolled foster parents with:
  • $300,000 per occurrence if someone decides to sue you for anything related to the child placed with you from the foster care system.  
  • $100,000 in legal defense in the event you get accused of something that would require you to hire an attorney. 
  • $20,000 (with a $250 deductible) in the event a child placed in your care from the foster care system destroys your personal property.

About Robert Brotemarkle

Robert A. Brotemarkle is the owner of Foster Parent Professionals, an insurance brokering and consulting firm that provides coverage, risk management services and specialized insurance consulting to foster parent organizations. He has written liability related articles for national publications and consults regularly with executive directors of social service agencies as well as state insurance departments and state children’s service agencies to aid them in insurance procurement and risk management.

In addition to his role at Foster Parent Professionals, he owns two insurance agencies in the Johnstown, Pennsylvania area, providing coverage for personal auto and fire customers as well as local small business. Robert has received the Agent of the Year award from the local chapter of the Association of Insurance and Financial Advisors, as well as various awards from major property and casualty insurance companies.

Foster Parent Professionals has been insuring foster parents since 1981.  Over 25,00 Foster Homes have foster parent liability insurance.  We specialize in defending foster parents from allegations of abuse.  We Foster Families across the country.  State Departments of Human Services, County Departments of Children and Youth, Private Non-Profit Social Services Providers, and For-Profit Foster Child Placement agencies purchase coverage through us for their Foster Homes.

  • Protection, if a foster child in your care is injured or dies and you are sued by the child’s biological parents
  • Coverage for claims of bodily injury or property damage caused by the foster child to someone outside the home
  • Incidental medical malpractice if you are held liable for your failure to provide needed medical care, therapy, diet or other special needs of your foster child
  • Optional limited protection for the foster parents’ belongings damaged by a foster child
  • Coverage limits available from $100,000 to $500,000
